The most basic form of a tenant / landlord agreement in the United Kingdom is the Assured Shorthold Tenancy (AST) agreement. This is the most used form of agreement for a residential tenancy and adheres to a few basic rules as laid down by The Housing Act 1988 and its amendments added in The Housing Act 1996. This act covers all the points required for such an agreement and offers the designated provisions for its treatment as a legally binding contract as this agreement acts as an assured tenancy to the landlord, whereby he has complete control over any need to regain his property when the fixed term is fulfilled.
Firstly, the yearly rent agreed must not be more than £ 25,000, and the initial term is to be fixed at no more than 3 years. Some of the stringent requirements are that the tenant must receive separate accommodation; the tenant must be an individual and must treat the dwelling as his principal home or property.
This agreement ends its consideration as an Assured Shorthold Tenancy agreement in case the landlord rents the property out to a company, or the rent paid is too low or not forthcoming, or if the landlord is in receipt of more than £25,000. There are other factors that can prevent the agreement from being recognised as an AST such as; the property must not be used as a holiday home; the landlord must not be a tenant in the same property; agricultural tenancies of over 2 acre land area or tenancies entered no later than 14th January 1989.
